WOOLWORTHS SHOPPER INSIGHTS EXPERIENCE:
TERMS AND CONDITIONS 

(“Terms”)


These Terms apply to all Woolworths customers who have elected to participate in the Woolworths Shopper Insights Experience and carry out certain assignments in respect thereof. Please read through them carefully before accepting them and participating in the Experience.

1.     The Woolworths Insights Experience:

1.1  The Woolworths (Pty) Ltd (“Woolworths”) Shopper Insights Experience (“Experience”) invites selected Woolworths customers to visit certain Woolworths stores incognito to assess the quality of the products and services that Woolworths offers.

1.2 Selected Woolworths customers that are invited to participate in the Experience by us, and who accept such invitation, are referred to in these Terms as “Insights Agent” or “you”.

1.3 Insights Agents will, via a designated Woolworths Shopper Insights App (“the App”), be provided with dates on which they must visit a specific Woolworths store to do their shopping; while doing their shopping, the Insights Agent will be requested to provide certain information regarding their shopping experience via the App (“the Assignment”). In exchange for the successful completion of an Assignment, Woolworths will reward the Insights Agent as set out in paragraph 3.

1.4 For the avoidance of doubt, Woolworths will not be paying for the products or services you purchase or procure during the Experience, that will be for your own account. Travel to and from the relevant Woolworths store will also be at your cost. Your sole compensation for your participation will be the Reward set out below. 

1.5 This Experience is not open to any of Woolworths’ employees and their family members, including the employees and family members of the Woolworths advertising and promotional agencies and distributors. All Insights Agents warrant that they have no personal interest in Woolworths. 


2. The Assignment/s: 

2.1 We cannot guarantee the number of Assignments you will receive from us during the Experience. Please note that we aren’t obliged to provide you with an Assignment and conversely, you are not obliged to accept an Assignment. 

2.2 You will be able to access your Assignment/s via the App and must complete any Assignment/s assigned to you within the time and at the location specified by us. Assignments may be varied from time to time. Please do not disclose your login details for the App to any third party.

2.3 It is important that you perform your Assignment/s: (a), fully, accurately, and honestly, (b) to the best of your ability, (c) with reasonable care and skill, and (d) in a professional manner that doesn’t damage the reputation or business interests of Woolworths. 

2.4 All Assignments are to be completed solely by you. You may not work with another person on your Assignment or request that another person carry out an Assignment on your behalf.

3. The Reward: 

3.1 We will give you 1 (one) Woolworths Gift Card to the value of R150.00 (one hundred and fifty rand) for each successfully completed, submitted and approved Assessment (“the Reward”). The Reward will be subject to the Woolworths gift card terms and conditions set out in paragraph 3.5. 

3.2 Assessments will be approved within 48 hours of submission, and Reward will reflect in the wallet that can be found in the Woolies Shopper Insights App on your phone.

3.3 To redeem your Reward(s) you will need to select the “Request Payout” button in the wallet section of the Woolies Shopper Insights App on your phone.

3.4 Reward payouts are done weekly, every Friday at noon. If the Friday falls on a public holiday, the Reward payout will be made on the relevant Thursday. 

3.5 Your Reward will be sent to you via SMS.

3.6 We reserve the right to withhold Reward where we, acting in our sole discretion, have determined that you have not complied with any provision of these Terms or the Woolworths values. 

3.7 Please note that should the Reward for any reason whatsoever become unavailable, Woolworths may in its sole discretion award a similar prize in value.

3.8 The Reward is subject to the Woolworths gift card voucher terms and conditions, as set out below:

3.8.1 Gift cards are only exchangeable for merchandise and may not be redeemed for cash.

3.8.2 No cash change will be given when redeeming a gift card.

3.8.3 Gift cards may not be redeemed against purchases made at any Woolworths store outside of the Republic of South Africa or at any Woolworths Food Stops at Engen.

3.8.4 Gift cards are valid for 36 (thirty-six) months from the date of issue.

3.8.5 Gift cards may not be used to make payments towards any Woolworths card, loan account or utilities account.

3.8.6 It is the responsibility of the gift card owner to safeguard the gift card as it cannot be replaced, or the value thereon redeemed if the gift card is lost or stolen.

3.8.7 Rewards may be kept in the wallet of the Woolies Shopper Insights App for a maximum of 6 (six) months or until there is a balance R3600 (three thousand six hundred rand) in the wallet, whichever comes first. Thereafter, the full balance in your wallet will be cashed out automatically (i.e., converted to a Reward amount) and sent to you via SMS.


4. Bi-monthly Vouchers: 

4.1 In addition to the Reward, Insights Agents will be sent an additional Woolworths voucher every 2 (two) months for the duration of their active participation in the Woolworths Shopper Insights Experience. For the avoidance of doubt, if you do not actively participate in the Experience you won’t receive a voucher. 

4.2 The product/s that the voucher may be spent on will fall within the categories of foods, fashion, beauty or homeware. The product category of the voucher awarded to the Insights Agent will be determined by Woolworths, acting in its sole discretion.  

4.3 Please note that vouchers are different from the Rewards (which are gift cards) as they are linked to a minimum spend threshold and expire after 2 (two) weeks. For more on how vouchers work, please see below:

4.3.1 The voucher must be used in conjunction with your Woolworths WRewards card, Woolworths Store Card, Woolworths Credit Card and/or MySchoolMyVillageMyPlanet card.

4.3.2 The voucher may not be used for utility payments, to purchase gift cards, be redeemed for cash or exchanged or refunded for cash or credit.

4.3.3 The voucher is valid only for 14 (fourteen) days from date of issue and is redeemable once.

4.3.4 It is the responsibility of the voucher owner to safeguard the voucher, as it cannot be replaced, and the value thereon cannot be redeemed if the voucher is lost or stolen.

4.3.5 Not all vouchers can be redeemed when shopping on www.woolworths.co.za, please check the WRewards Terms and Conditions on the link below to determine whether this voucher can be used online, in store or both.

4.3.6 The voucher is not transferable, not exchangeable and cannot be exchanged for its cash value. 


5. Confidentiality: 

Your participation in the Experience is strictly confidential. You agree that under no circumstances will you reveal yourself as an Insights Agent or disclose any information regarding the Experience to a third party, this includes posting about the Experience on social media sites. 


6. Personal Information: 

All personal information that you share with us during the Experience will be processed in accordance with our Privacy Policy, which can be accessed at: https://www.woolworths.co.za/corporate/cmp205289. The personal information that you share will only be used for purposes of this Experience and may be shared with third parties who assist us in the implementation and maintenance of the Experience. Any reference to Woolworths in these terms and conditions shall be deemed to include reference to Woolworths (Pty) Ltd, Woolworths Financial Services (Pty) Ltd and any of their holding, associated or sister companies and subsidiaries. Please note that when you share your information with one of these companies, you agree to also sharing it with others within the Woolworths group of companies. 


7. Termination by you: 

If you no longer wish to be an Insights Agent, please contact us at the Insights Shopper WhatsApp line on +27 82 66 438 5669 and we will remove you from our database. 


8. Termination by us: 

The Experience may be terminated by us at any time. If we, acting in our sole discretion, believe that you have not abided by these Terms, including but not limited to a failure by you to: (a) complete your Assignment within the specified time, (b) conduct the Assignment as per our instructions, or (c) provide us with true and accurate information in your Assignment or any other feedback that we may require, we reserve the right to withhold payment of the Reward in respect of all Assignments completed by you and to remove you from the Experience. 


9. Circumstances beyond Woolworths’ control: 

If any act, omission, event or circumstance occurs which is not reasonably foreseeable or is beyond the reasonable control of Woolworths and which delays or prevents Woolworths from complying with these Terms, Woolworths will not be liable for any failure to perform or delay in performing its obligations. 


10. Indemnity: 

By participating in the Experience, you agree to indemnify Woolworths, and release and hold Woolworths harmless against any and all losses, damages, rights, claims and actions of any kind in connection with this Experience or resulting from acceptance and participation in the Experience including, without limitation, personal injuries, death, and property damage, and claims based on publicity rights, defamation or invasion of privacy.


11. Relationship: 

Your acceptance of these Terms and your participation in the Woolworths Insights Shopper Experience does not create any form of employment contract between yourself and Woolworths. 


12. Amendments to these Terms: 

These Terms may be amended by Woolworths at any time, without notice. 


13. Governing Law: 

These Terms and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of South Africa, and you submit yourself to jurisdiction of the Western Cape High Court of South Africa (Cape Town).
